A student started working for us a few weeks ago, but he completed a P46 rather than a P38s. He's complaining about paying tax now. Can I get him to do a P38s now? Will 12Pay accept it and adjust his tax status correctly? Will the HMRC accept it, when I file online?

Whether or not you can transfer an employee from normal employed status to P38S status once you've sent a P46 to HMRC isn't something that we can easily answer; probably you need to consult your tax office, who may advise you to make them a leaver and restart them on a P38S (though you couldn't then get back the tax already paid, the student would have to do that themselves by talking to HMRC directly).

In the software you could perfectly well tick the P38S box and remove their tax code. I'm just not sure that is permitted under HMRC rules.
